Legal Notice and Terms of Use for Statuemap

I. Introduction

The website www.statuemap.com (hereon referred to as Statuemap) is operated by Tamás Pál (hereon referred to as Operator). Users of Statuemap are all visitors who open the Statuemap website, study its content or use the website's services (hereon referred to as You).

II. Copyright

1. By uploading or relaying any intellectual property, opinion or image to Statuemap, You are agreeing to let the Operator use and publish these texts and images free of charge and without temporal or spatial limitation (as regulated by Hungarian copyright law LXXVI. of 1999 [hereon referred to as Sztv.] paragraphs 16. §. (1), (4) ). Operator is entitled to partial or complete publication of all uploaded texts and images on third parties' websites. Operator is exempt from paying any fee for the uploading of any content on Statuemap, or any related activity including the publication of uploaded texts or images.

2. You are only permitted to upload to Statuemap texts and images that are your own intellectual property or are in the public domain (Sztv. 33. § - 34. §).

3. By acknowledging the terms of use, You accept and agree to refrain from items protected under copyright or confidentiality, or any material that may infringe rights of privacy, except when the rights and decision are in possession of the uploading party, or if the right holder gives valid official permission to the uploader.

4. Any copying, broadcasting, distributing, playing or any such use of the copyright protected texts and images on Statuemap may only take place with official permission from Operator.

5. On downloading or printing any material from Statuemap, You are required to indicate copyright and other such property rights on the new copy.

6. Photographs appearing on Statuemap may be used under condition of indicating the download source as follows: „www.statuemap.hu / name of image uploader”. Modification of materials downloaded from Statuemap is only permitted in cases where this is explicitly necessary for the purposes of use. Removing the image's watermark nullifies the right to secondary publication. In case of mass photo use (min. 10 images) please give notice to the chief editor of Statuemap via the Contact subpage.

7. Images found on Statuemap may fall under copyright protection. Copyright is owned by the image's producer (Sztv. 9.§). Operator takes no responsibility for unauthorized publication of copyright protected images uploaded on Statuemap, due to the fact that Statuemap users submit or upload the images. Operator has no means to control the lawfullness of use of submitted pictures, this responsibility belongs to the uploaders. In case published or adapted images infringe any rights or interests of their producer, copyright holder or representative, Operator will on request remove the copyright protected items from Statuemap.

8. By registering, You accept that Operator or the appointed chief editor may reject/inactivate your uploads, if these fail to meet the website's legal regulations or uploading conditions.

9. Your uploads will remain on Statuemap in case of a deletion of your registration, they are not deleted automatically. You will of course remain the owner of your images.

III. Disclaimer of warranties and limitations on liability

1. Operator accepts no responsibility of confidentiality and/or security for materials made available on or through Statuemap.

2. Operator accepts no responsibility for erroneous, partial or miscategorized descriptions or images of a statue/memorial featured on Statuemap.

3. Operator does not check or control every user's uploaded texts, images and comments before these are made available to third parties. Accessible material may contain objectionable, unacceptable or offensive elements. Operator cannot guarantee automatic removal of such materials from the website, and accepts no responsibility for their presence.

4. You are not permitted to publish illegal, obscene, libelous, intimidating, erotic, pornographic, racially or ethnically offensive, or otherwise objectionable material, nor are You permitted to publish links to such material.

5. You are required to accept full personal responsibility for materials that You have published and made accessible to everyone on Statuemap, and any consequences thereof.

6. Comments posted to artwork/statues are only displayed by Operator, their contents do not reflect Operator's views or opinions. Operator is not responsible for the content. Submitted comments appear on the webpage instantly without previous moderation or censorship.

7. You are not permitted to publish content based on intentionally misleading information which may harm Operator and/or any third party.

8. Operator is not liable for any damages arising from the use of Statuemap.

9. Operator and/or the Operator's associates accept no responsibility or liability for any of the cases listed below:

• any material or immaterial damage arising from the use of Statuemap,
• any unauthorized access to the Statuemap database and the resulting abuse of personal data,
• any manner of disruption or discontinuation of data transfer to and/or from Statuemap,
• any viral infection downloaded during the use of Statuemap or associated websites.

10. Operator and/or the Operator's associates accept no responsibility or liability for controlling information, advertisements, or associated websites accessible on or downloadable from Statuemap, or for controlling any transaction undertaken with third parties.

11. Though Operator will do everything required to relay messages sent on Statuemap to their addressees, Operator takes no responsibility for lost or misdirected messages. Certain spam filters may filter emails from Statuemap, loss of emailed content can therefore occur due to factors beyond the Operator's regulatory power.

12. To enable a more simple and rapid handling of the Statuemap system, verification of users' email or identity are not required for sending messages. Sending messages from Statuemap usurping others' name or email address is strictly forbidden. Operator assumes no responsibility for messages sent under false pretense of identity or email address.

IV. Data management

1. Registration is required to use some of the services available on Statuemap. You are required to submit accurate information during your registration, as prescribed by the registration form and Personal information subpages. You are responsible for your registration's confidentiality. Operator accepts no responsibility for any abuse of user names and/or passwords. In any case of security breach or unauthorized use, You are required to notify Operator immediately at the email address under the Contact menu item. In case of unauthorized use of your user name and password, You are accountable for any loss suffered by the Operator.

2. In case You or the producer of the uploaded images state information on Statuemap about yourself or the images whereby You are personally identifiable, You thereby accept that Operator stores and uses this information in accordance to the Hungarian law in force (law LXIII. of 1992 on protection of private data and disclosure of data in the public interest [hereon referred to as: Atv.] paragraph 3. § (1)).

3. Operator takes no responsibility for - publicly accessible - personal information uploaded by third parties. Uploads are not monitored by Operator for personal content.

4. On Statuemap, You are forbidden to collect data which can be used for personal identification.

5. By submitting your data, you agree to have Operator register them, and to contact you with offers and news related to Operator's free websites. Personal data stored in the database will not be disclosed by Operator to third parties under any circumstance. You may delete your personal information at any time you choose, you may do so in writing with an email sent from your registered email address and quoting any unique identifier.

6. Operator may delete the registry forms from the database at any time. This may result in the loss of uploaded texts and images. Operator takes no responsibility for lost text or image content, and we kindly ask you to save copies of your important content on your own computer.

V. Disclaimer of warranties and limitations on liability for third parties' websites

1. You can access other websites through the Statuemap pages, aiding the uploading process (eg.: Google Maps). These services are in all cases owned and operated by third parties, whose development plans and service operations are beyond Operator's influence.

2. When using associated websites, the terms and conditions set forth by the website owner or operator are to be abided by. Any error on their part is no responsibility of the Operator's.

VI. General legal terms

1. You acknowledge and agree that the materials You upload are accessible to others and that their downloading may benefit Operator, which benefits or their share are not available to the content's uploader, and surrenders all such claims to Operator's benefits (Sztv. paragraph 16. § (4)).

2. Any breach or violation of the above terms entitles Operator to remove offensive material (text, images, comments etc.) from Statuemap, and to ban the user from using the website.

3. Operator is entitled to update the above terms and conditions of use, and may do so at his discretion without prior notice. We recommend that You browse through the terms of use from time to time, to ensure You are always up to date.

4. By registering to Statuemap, you accept the terms of use. In addition to the above, you also explicitly waive your right to retract or modify this declaration in any way. You also guarantee that you are eligible to make this declaration which does not infringe copyright or other rights.
